Welcome to Vibe! By accessing or using our mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
These Terms constitute a legally binding agreement between you and Vibe Intelligent Technologies ("Vibe," "we," "us," or "our"). We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

You are responsible for all activity that occurs under your account. You agree to immediately notify us of any breach of security or unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
You may only create one account. Creating multiple accounts, fake accounts, or accounts on behalf of others without permission is prohibited and may result in termination of all accounts.
When using Vibe, you agree not to:
You retain ownership of content you create and share on Vibe (photos, videos, posts, messages). However, by posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute your content for the purpose of operating and improving the Service.
We reserve the right (but have no obligation) to monitor, review, and remove content that violates these Terms or our Community Guidelines. We may take action including warnings, content removal, or account suspension/termination.
Vibe requires access to your device's location services to provide core features. By using the Service, you consent to our collection and use of your location data as described in our Privacy Policy.
We collect location data in the background to provide real-time venue busyness updates and foot traffic analytics. You can disable background location in your device settings, but this will limit certain app features.
Your current location and venue check-ins may be visible to other users based on your privacy settings. You can control visibility through your account settings.
The Service, including its design, code, graphics, logo, and trademarks, is owned by Vibe and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.
If you provide us with feedback, suggestions, or ideas, you grant us the right to use them without compensation or attribution.

We are not responsible for the conduct of users on or off the Service. You agree to take reasonable precautions in all interactions with other users.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR SERVICE INTERRUPTION.

We may suspend or terminate your account at any time, with or without notice, for any reason, including:
Upon termination, your right to use the Service immediately ceases. We may delete your account and content. Sections of these Terms that by their nature should survive termination will survive (including intellectual property, disclaimers, and limitations of liability).
These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Brisbane, Australia, except that either party may seek injunctive relief in court.
You agree to resolve disputes with us on an individual basis and waive your right to participate in class actions or representative proceedings.
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Vibe regarding the Service.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.
